安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)是(shi)關系人(ren)民(min)(min)群眾生(sheng)(sheng)命財產(chan)(chan)(chan)安(an)全(quan)(quan)(quan)的大事,是(shi)經(jing)濟社(she)會協調(diao)健康發(fa)(fa)展(zhan)的標志,是(shi)黨(dang)和(he)(he)政府對人(ren)民(min)(min)利益高度負責的要求。黨(dang)中央、國(guo)(guo)務院(yuan)歷來高度重視安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)工作(zuo),黨(dang)的十八大以來作(zuo)出(chu)一系列(lie)重大決策部署,推(tui)動(dong)全(quan)(quan)(quan)國(guo)(guo)安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)工作(zuo)取得積極進展(zhan)。同(tong)時也要看到,當前我國(guo)(guo)正(zheng)處在工業(ye)化、城(cheng)鎮化持(chi)續(xu)推(tui)進過程(cheng)中,生(sheng)(sheng)產(chan)(chan)(chan)經(jing)營(ying)規模不(bu)斷擴大,傳統和(he)(he)新型生(sheng)(sheng)產(chan)(chan)(chan)經(jing)營(ying)方式(shi)并存,各類事故(gu)(gu)隱患和(he)(he)安(an)全(quan)(quan)(quan)風險交織疊(die)加,安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)基礎(chu)薄弱、監(jian)管(guan)體制機制和(he)(he)法律制度不(bu)完善(shan)、企(qi)業(ye)主體責任落實不(bu)力等問題依然突出(chu),生(sheng)(sheng)產(chan)(chan)(chan)安(an)全(quan)(quan)(quan)事故(gu)(gu)易發(fa)(fa)多(duo)發(fa)(fa),尤其(qi)是(shi)重特大安(an)全(quan)(quan)(quan)事故(gu)(gu)頻(pin)發(fa)(fa)勢(shi)頭尚未(wei)得到有(you)效(xiao)遏制,一些(xie)事故(gu)(gu)發(fa)(fa)生(sheng)(sheng)呈現由高危行業(ye)領(ling)域(yu)向(xiang)其(qi)他行業(ye)領(ling)域(yu)蔓延趨勢(shi),直接危及生(sheng)(sheng)產(chan)(chan)(chan)安(an)全(quan)(quan)(quan)和(he)(he)公共安(an)全(quan)(quan)(quan)。為進一步加強安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)工作(zuo),現就推(tui)進安(an)全(quan)(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)領(ling)域(yu)改(gai)革發(fa)(fa)展(zhan)提出(chu)如下意見。

一(yi)、總體(ti)要求

(一)指(zhi)導(dao)思(si)想。全(quan)面(mian)貫(guan)徹(che)黨的(de)十八大(da)和十八屆三中、四(si)中、五(wu)中、六中全(quan)會精(jing)神,以鄧小(xiao)平(ping)理論、“三個(ge)代表(biao)”重要思(si)想、科學發展(zhan)(zhan)(zhan)觀為(wei)指(zhi)導(dao),深入貫(guan)徹(che)習近平(ping)總書記(ji)系列重要講(jiang)話精(jing)神和治(zhi)(zhi)國理政新(xin)理念(nian)新(xin)思(si)想新(xin)戰(zhan)略(lve)(lve),進(jin)(jin)一步增強“四(si)個(ge)意(yi)識”,緊緊圍繞統籌推進(jin)(jin)“五(wu)位一體”總體布局和協調(diao)推進(jin)(jin)“四(si)個(ge)全(quan)面(mian)”戰(zhan)略(lve)(lve)布局,牢固樹立新(xin)發展(zhan)(zhan)(zhan)理念(nian),堅持安(an)(an)全(quan)發展(zhan)(zhan)(zhan),堅守發展(zhan)(zhan)(zhan)決不(bu)(bu)能(neng)以犧牲(sheng)安(an)(an)全(quan)為(wei)代價這條(tiao)不(bu)(bu)可逾越的(de)紅線,以防范(fan)遏(e)制重特大(da)生產(chan)安(an)(an)全(quan)事故為(wei)重點,堅持安(an)(an)全(quan)第(di)一、預防為(wei)主、綜合治(zhi)(zhi)理的(de)方針,加強領導(dao)、改革創新(xin),協調(diao)聯(lian)動、齊(qi)抓(zhua)共管(guan),著(zhu)力(li)強化企業安(an)(an)全(quan)生產(chan)主體責任(ren)(ren),著(zhu)力(li)堵塞(sai)監督管(guan)理漏洞,著(zhu)力(li)解決不(bu)(bu)遵守法律法規的(de)問題,依靠嚴(yan)密的(de)責任(ren)(ren)體系、嚴(yan)格(ge)的(de)法治(zhi)(zhi)措施、有效的(de)體制機(ji)制、有力(li)的(de)基礎(chu)保障和完善的(de)系統治(zhi)(zhi)理,切實(shi)增強安(an)(an)全(quan)防范(fan)治(zhi)(zhi)理能(neng)力(li),大(da)力(li)提升(sheng)我國安(an)(an)全(quan)生產(chan)整體水平(ping),確(que)保人(ren)民(min)群眾安(an)(an)康幸福、共享改革發展(zhan)(zhan)(zhan)和社會文(wen)明進(jin)(jin)步成果。

(二)基本原則

——堅持(chi)安(an)全(quan)(quan)發(fa)展(zhan)(zhan)。貫徹以人民為中心的(de)發(fa)展(zhan)(zhan)思想,始(shi)終把(ba)人的(de)生命(ming)安(an)全(quan)(quan)放在首位,正確處理安(an)全(quan)(quan)與發(fa)展(zhan)(zhan)的(de)關(guan)系,大力實施安(an)全(quan)(quan)發(fa)展(zhan)(zhan)戰略,為經(jing)濟社會發(fa)展(zhan)(zhan)提(ti)供(gong)強有力的(de)安(an)全(quan)(quan)保障。

——堅持改(gai)革創(chuang)(chuang)新(xin)。不斷推(tui)進安(an)(an)全(quan)生產(chan)(chan)理論創(chuang)(chuang)新(xin)、制(zhi)度(du)創(chuang)(chuang)新(xin)、體制(zhi)機(ji)制(zhi)創(chuang)(chuang)新(xin)、科技創(chuang)(chuang)新(xin)和文化創(chuang)(chuang)新(xin),增(zeng)強企業(ye)內(nei)生動(dong)力,激發(fa)全(quan)社會創(chuang)(chuang)新(xin)活(huo)力,破解(jie)安(an)(an)全(quan)生產(chan)(chan)難題,推(tui)動(dong)安(an)(an)全(quan)生產(chan)(chan)與經濟社會協調(diao)發(fa)展。

——堅(jian)持依法(fa)監(jian)管(guan)。大力弘(hong)揚社會主義法(fa)治(zhi)精神(shen),運用(yong)法(fa)治(zhi)思維和法(fa)治(zhi)方式,深化(hua)安(an)全(quan)(quan)生產監(jian)管(guan)執(zhi)(zhi)(zhi)法(fa)體制改(gai)革,完善安(an)全(quan)(quan)生產法(fa)律法(fa)規和標準體系,嚴格規范公(gong)正文(wen)明執(zhi)(zhi)(zhi)法(fa),增強監(jian)管(guan)執(zhi)(zhi)(zhi)法(fa)效(xiao)能,提高安(an)全(quan)(quan)生產法(fa)治(zhi)化(hua)水(shui)平。

——堅持源頭防范。嚴格安(an)(an)全(quan)生(sheng)(sheng)產(chan)(chan)市場準入(ru),經(jing)濟社會(hui)發(fa)展(zhan)要以安(an)(an)全(quan)為前提(ti),把(ba)安(an)(an)全(quan)生(sheng)(sheng)產(chan)(chan)貫(guan)穿城鄉(xiang)規劃布局、設(she)計(ji)、建設(she)、管理和企業(ye)生(sheng)(sheng)產(chan)(chan)經(jing)營活(huo)動(dong)全(quan)過程。構建風險分級(ji)管控和隱患(huan)(huan)排查治理雙重預防工(gong)作機制,嚴防風險演(yan)變、隱患(huan)(huan)升級(ji)導致(zhi)生(sheng)(sheng)產(chan)(chan)安(an)(an)全(quan)事(shi)故發(fa)生(sheng)(sheng)。

——堅持系統(tong)治(zhi)理(li)。嚴密層級治(zhi)理(li)和行業治(zhi)理(li)、政府治(zhi)理(li)、社會(hui)(hui)治(zhi)理(li)相結合(he)的安(an)全(quan)生產治(zhi)理(li)體系,組織動員各方面力量(liang)實施社會(hui)(hui)共治(zhi)。綜(zong)合(he)運用法(fa)律、行政、經濟、市場等(deng)手段,落(luo)實人防(fang)(fang)、技防(fang)(fang)、物防(fang)(fang)措施,提升全(quan)社會(hui)(hui)安(an)全(quan)生產治(zhi)理(li)能力。

(三)目標任務。到2020年,安(an)全(quan)生(sheng)產監管體制機制基(ji)本成(cheng)熟(shu),法律制度(du)基(ji)本完善,全(quan)國(guo)生(sheng)產安(an)全(quan)事(shi)故(gu)總量明顯減(jian)少,職業病危害防(fang)治取得(de)積極進(jin)展(zhan),重特大生(sheng)產安(an)全(quan)事(shi)故(gu)頻發勢頭得(de)到有效遏制,安(an)全(quan)生(sheng)產整體水平(ping)與(yu)全(quan)面(mian)建成(cheng)小康社會目標(biao)相適應。到2030年,實現(xian)安全生產(chan)治理體系和(he)治理能力現(xian)代化,全民(min)安全文明素質全面提升(sheng),安全生產(chan)保障(zhang)能力顯著增強,為(wei)實現(xian)中(zhong)(zhong)華民(min)族偉大(da)復(fu)興的(de)中(zhong)(zhong)國(guo)夢(meng)奠定穩固可靠的(de)安全生產(chan)基礎。

二、健(jian)全落實安全生產責(ze)任制

(四)明確地(di)(di)方黨(dang)(dang)(dang)委(wei)和政(zheng)(zheng)府(fu)領(ling)(ling)(ling)導責任(ren)(ren)。堅持黨(dang)(dang)(dang)政(zheng)(zheng)同責、一(yi)崗雙責、齊抓共(gong)管(guan)、失(shi)職追責,完善(shan)安全(quan)生產責任(ren)(ren)體系。地(di)(di)方各(ge)級黨(dang)(dang)(dang)委(wei)和政(zheng)(zheng)府(fu)要(yao)始終把安全(quan)生產擺在重要(yao)位置(zhi),加強組(zu)織領(ling)(ling)(ling)導。黨(dang)(dang)(dang)政(zheng)(zheng)主要(yao)負(fu)責人是本地(di)(di)區安全(quan)生產第一(yi)責任(ren)(ren)人,班子(zi)其他成(cheng)(cheng)員對分管(guan)范圍內的安全(quan)生產工作負(fu)領(ling)(ling)(ling)導責任(ren)(ren)。地(di)(di)方各(ge)級安全(quan)生產委(wei)員會主任(ren)(ren)由政(zheng)(zheng)府(fu)主要(yao)負(fu)責人擔任(ren)(ren),成(cheng)(cheng)員由同級黨(dang)(dang)(dang)委(wei)和政(zheng)(zheng)府(fu)及(ji)相關部門負(fu)責人組(zu)成(cheng)(cheng)。

地方各(ge)級黨委(wei)要認真貫徹(che)執行黨的(de)安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)方針(zhen),在統攬本(ben)地區經濟社(she)會發展全(quan)(quan)局中同步推進安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)工(gong)作(zuo)(zuo),定期研究決定安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)重大問題。加強(qiang)安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)監(jian)管機構領導(dao)班子(zi)、干部隊伍建設。嚴格安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)履職(zhi)績效考核和失職(zhi)責(ze)任追究。強(qiang)化安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)宣傳(chuan)教(jiao)育和輿論(lun)引導(dao)。發揮人大對安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)工(gong)作(zuo)(zuo)的(de)監(jian)督促進作(zuo)(zuo)用(yong)、政協對安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)工(gong)作(zuo)(zuo)的(de)民主(zhu)監(jian)督作(zuo)(zuo)用(yong)。推動組織、宣傳(chuan)、政法(fa)、機構編制等(deng)單位(wei)支持(chi)保障安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)工(gong)作(zuo)(zuo)。動員社(she)會各(ge)界(jie)積(ji)極(ji)參與、支持(chi)、監(jian)督安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)(chan)工(gong)作(zuo)(zuo)。

地(di)方各級(ji)(ji)政(zheng)府要把安(an)(an)全(quan)(quan)生產(chan)納(na)入經(jing)濟社會發展總體規(gui)劃,制(zhi)定實(shi)(shi)施(shi)安(an)(an)全(quan)(quan)生產(chan)專項規(gui)劃,健全(quan)(quan)安(an)(an)全(quan)(quan)投入保障制(zhi)度(du)。及時研究部(bu)署(shu)安(an)(an)全(quan)(quan)生產(chan)工作(zuo),嚴(yan)格(ge)落實(shi)(shi)屬地(di)監(jian)管(guan)(guan)(guan)責(ze)任(ren)。充(chong)分發揮安(an)(an)全(quan)(quan)生產(chan)委員會作(zuo)用,實(shi)(shi)施(shi)安(an)(an)全(quan)(quan)生產(chan)責(ze)任(ren)目(mu)標(biao)管(guan)(guan)(guan)理(li)。建立安(an)(an)全(quan)(quan)生產(chan)巡查制(zhi)度(du),督促(cu)(cu)各部(bu)門和下(xia)級(ji)(ji)政(zheng)府履(lv)職盡責(ze)。加(jia)強安(an)(an)全(quan)(quan)生產(chan)監(jian)管(guan)(guan)(guan)執法能力(li)建設,推進安(an)(an)全(quan)(quan)科技創(chuang)新,提升信息化管(guan)(guan)(guan)理(li)水平。嚴(yan)格(ge)安(an)(an)全(quan)(quan)準入標(biao)準,指導管(guan)(guan)(guan)控安(an)(an)全(quan)(quan)風(feng)險(xian),督促(cu)(cu)整治重大隱(yin)患,強化源頭治理(li)。加(jia)強應(ying)急管(guan)(guan)(guan)理(li),完善安(an)(an)全(quan)(quan)生產(chan)應(ying)急救(jiu)援體系。依法依規(gui)開展事故調查處理(li),督促(cu)(cu)落實(shi)(shi)問題整改。

(五)明確部(bu)(bu)(bu)(bu)門(men)(men)監(jian)管(guan)(guan)(guan)(guan)(guan)責任(ren)。按照管(guan)(guan)(guan)(guan)(guan)行(xing)(xing)業必須管(guan)(guan)(guan)(guan)(guan)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)、管(guan)(guan)(guan)(guan)(guan)業務(wu)必須管(guan)(guan)(guan)(guan)(guan)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)、管(guan)(guan)(guan)(guan)(guan)生(sheng)產(chan)經營必須管(guan)(guan)(guan)(guan)(guan)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)和(he)誰(shui)主(zhu)管(guan)(guan)(guan)(guan)(guan)誰(shui)負責的(de)(de)原則(ze),厘清安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)綜(zong)合監(jian)管(guan)(guan)(guan)(guan)(guan)與行(xing)(xing)業監(jian)管(guan)(guan)(guan)(guan)(guan)的(de)(de)關(guan)系(xi),明確各有(you)(you)關(guan)部(bu)(bu)(bu)(bu)門(men)(men)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)和(he)職(zhi)(zhi)(zhi)業健(jian)康(kang)工(gong)作職(zhi)(zhi)(zhi)責,并落實到部(bu)(bu)(bu)(bu)門(men)(men)工(gong)作職(zhi)(zhi)(zhi)責規(gui)(gui)(gui)(gui)定中。安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)監(jian)督(du)管(guan)(guan)(guan)(guan)(guan)理(li)(li)部(bu)(bu)(bu)(bu)門(men)(men)負責安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)法(fa)(fa)規(gui)(gui)(gui)(gui)標(biao)準和(he)政策規(gui)(gui)(gui)(gui)劃(hua)制(zhi)定修訂、執法(fa)(fa)監(jian)督(du)、事(shi)故(gu)調查處理(li)(li)、應急救援(yuan)管(guan)(guan)(guan)(guan)(guan)理(li)(li)、統計分析、宣傳教育培(pei)訓等(deng)綜(zong)合性工(gong)作,承擔職(zhi)(zhi)(zhi)責范圍內(nei)行(xing)(xing)業領域(yu)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)和(he)職(zhi)(zhi)(zhi)業健(jian)康(kang)監(jian)管(guan)(guan)(guan)(guan)(guan)執法(fa)(fa)職(zhi)(zhi)(zhi)責。負有(you)(you)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)監(jian)督(du)管(guan)(guan)(guan)(guan)(guan)理(li)(li)職(zhi)(zhi)(zhi)責的(de)(de)有(you)(you)關(guan)部(bu)(bu)(bu)(bu)門(men)(men)依法(fa)(fa)依規(gui)(gui)(gui)(gui)履行(xing)(xing)相關(guan)行(xing)(xing)業領域(yu)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)和(he)職(zhi)(zhi)(zhi)業健(jian)康(kang)監(jian)管(guan)(guan)(guan)(guan)(guan)職(zhi)(zhi)(zhi)責,強(qiang)化監(jian)管(guan)(guan)(guan)(guan)(guan)執法(fa)(fa),嚴厲(li)查處違(wei)法(fa)(fa)違(wei)規(gui)(gui)(gui)(gui)行(xing)(xing)為。其他行(xing)(xing)業領域(yu)主(zhu)管(guan)(guan)(guan)(guan)(guan)部(bu)(bu)(bu)(bu)門(men)(men)負有(you)(you)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)管(guan)(guan)(guan)(guan)(guan)理(li)(li)責任(ren),要將安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)工(gong)作作為行(xing)(xing)業領域(yu)管(guan)(guan)(guan)(guan)(guan)理(li)(li)的(de)(de)重要內(nei)容,從行(xing)(xing)業規(gui)(gui)(gui)(gui)劃(hua)、產(chan)業政策、法(fa)(fa)規(gui)(gui)(gui)(gui)標(biao)準、行(xing)(xing)政許可等(deng)方(fang)面加(jia)強(qiang)行(xing)(xing)業安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)工(gong)作,指導督(du)促企(qi)事(shi)業單位加(jia)強(qiang)安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)管(guan)(guan)(guan)(guan)(guan)理(li)(li)。黨委和(he)政府其他有(you)(you)關(guan)部(bu)(bu)(bu)(bu)門(men)(men)要在職(zhi)(zhi)(zhi)責范圍內(nei)為安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)生(sheng)產(chan)工(gong)作提(ti)供支持保障,共(gong)同(tong)推進安(an)(an)(an)(an)(an)全(quan)(quan)(quan)(quan)(quan)(quan)發展。

(七)健全(quan)(quan)責(ze)任(ren)考核(he)(he)機制(zhi)(zhi)。建(jian)立(li)與全(quan)(quan)面建(jian)成(cheng)小(xiao)康(kang)社會(hui)相(xiang)適應和體現(xian)安(an)(an)全(quan)(quan)發展(zhan)水(shui)平的考核(he)(he)評(ping)價(jia)體系。完善考核(he)(he)制(zhi)(zhi)度(du),統籌整合、科學(xue)設定安(an)(an)全(quan)(quan)生(sheng)產(chan)考核(he)(he)指標,加大安(an)(an)全(quan)(quan)生(sheng)產(chan)在社會(hui)治安(an)(an)綜(zong)合治理、精(jing)神(shen)文明建(jian)設等(deng)考核(he)(he)中的權重。各級政府(fu)要(yao)對同級安(an)(an)全(quan)(quan)生(sheng)產(chan)委(wei)員(yuan)會(hui)成(cheng)員(yuan)單位和下級政府(fu)實施嚴格的安(an)(an)全(quan)(quan)生(sheng)產(chan)工作責(ze)任(ren)考核(he)(he),實行過程考核(he)(he)與結(jie)果考核(he)(he)相(xiang)結(jie)合。各地(di)區(qu)各單位要(yao)建(jian)立(li)安(an)(an)全(quan)(quan)生(sheng)產(chan)績效與履職評(ping)定、職務(wu)晉升、獎勵懲處掛(gua)鉤制(zhi)(zhi)度(du),嚴格落(luo)實安(an)(an)全(quan)(quan)生(sheng)產(chan)“一票否決”制(zhi)(zhi)度(du)。

(八)嚴(yan)格責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)(zhui)究制(zhi)度。實行(xing)(xing)黨政領導干部任(ren)(ren)(ren)期安(an)全(quan)生產責(ze)(ze)(ze)任(ren)(ren)(ren)制(zhi),日(ri)常工作依(yi)(yi)責(ze)(ze)(ze)盡(jin)職(zhi)(zhi)、發生事故(gu)依(yi)(yi)責(ze)(ze)(ze)追(zhui)(zhui)究。依(yi)(yi)法(fa)依(yi)(yi)規(gui)制(zhi)定各有關部門安(an)全(quan)生產權力和(he)(he)責(ze)(ze)(ze)任(ren)(ren)(ren)清單(dan),盡(jin)職(zhi)(zhi)照單(dan)免(mian)責(ze)(ze)(ze)、失職(zhi)(zhi)照單(dan)問(wen)責(ze)(ze)(ze)。建立企業生產經(jing)營全(quan)過程安(an)全(quan)責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)(zhui)溯制(zhi)度。嚴(yan)肅查處安(an)全(quan)生產領域項目審批、行(xing)(xing)政許(xu)可(ke)、監管執法(fa)中(zhong)的(de)(de)失職(zhi)(zhi)瀆職(zhi)(zhi)和(he)(he)權錢(qian)交易等腐敗行(xing)(xing)為。嚴(yan)格事故(gu)直報(bao)制(zhi)度,對(dui)瞞(man)報(bao)、謊(huang)報(bao)、漏報(bao)、遲報(bao)事故(gu)的(de)(de)單(dan)位和(he)(he)個人依(yi)(yi)法(fa)依(yi)(yi)規(gui)追(zhui)(zhui)責(ze)(ze)(ze)。對(dui)被追(zhui)(zhui)究刑事責(ze)(ze)(ze)任(ren)(ren)(ren)的(de)(de)生產經(jing)營者依(yi)(yi)法(fa)實施相應(ying)的(de)(de)職(zhi)(zhi)業禁入,對(dui)事故(gu)發生負有重大責(ze)(ze)(ze)任(ren)(ren)(ren)的(de)(de)社(she)會服務機構和(he)(he)人員依(yi)(yi)法(fa)嚴(yan)肅追(zhui)(zhui)究法(fa)律責(ze)(ze)(ze)任(ren)(ren)(ren),并依(yi)(yi)法(fa)實施相應(ying)的(de)(de)行(xing)(xing)業禁入。

三、改(gai)革安全監管(guan)監察體制(zhi)

(十(shi))改革重點(dian)行(xing)業(ye)領(ling)域安(an)(an)(an)(an)全(quan)監(jian)(jian)管監(jian)(jian)察體(ti)(ti)制(zhi)。依托國家煤(mei)礦安(an)(an)(an)(an)全(quan)監(jian)(jian)察體(ti)(ti)制(zhi),加(jia)強非煤(mei)礦山安(an)(an)(an)(an)全(quan)生(sheng)產監(jian)(jian)管監(jian)(jian)察,優化安(an)(an)(an)(an)全(quan)監(jian)(jian)察機構布(bu)局,將國家煤(mei)礦安(an)(an)(an)(an)全(quan)監(jian)(jian)察機構負責的(de)安(an)(an)(an)(an)全(quan)生(sheng)產行(xing)政(zheng)許(xu)可事項(xiang)移交給地方(fang)政(zheng)府承擔。著(zhu)重加(jia)強危(wei)險化學(xue)品(pin)安(an)(an)(an)(an)全(quan)監(jian)(jian)管體(ti)(ti)制(zhi)改革和力量建設(she),明確和落實危(wei)險化學(xue)品(pin)建設(she)項(xiang)目立項(xiang)、規(gui)劃、設(she)計、施工及生(sheng)產、儲存、使用、銷售、運輸、廢(fei)棄處置等環節的(de)法定安(an)(an)(an)(an)全(quan)監(jian)(jian)管責任,建立有力的(de)協調聯動機制(zhi),消(xiao)除監(jian)(jian)管空(kong)白(bai)。完善海(hai)洋石油(you)安(an)(an)(an)(an)全(quan)生(sheng)產監(jian)(jian)督(du)管理(li)體(ti)(ti)制(zhi)機制(zhi),實行(xing)政(zheng)企(qi)分(fen)開。理(li)順民航、鐵路、電力等行(xing)業(ye)跨(kua)區域監(jian)(jian)管體(ti)(ti)制(zhi),明確行(xing)業(ye)監(jian)(jian)管、區域監(jian)(jian)管與地方(fang)監(jian)(jian)管職責。

(十一)進一步完(wan)(wan)善地方監(jian)(jian)管(guan)執(zhi)法(fa)(fa)體制。地方各(ge)級黨委和政(zheng)(zheng)府要將安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)(jian)督(du)(du)管(guan)理(li)部(bu)門作為政(zheng)(zheng)府工作部(bu)門和行政(zheng)(zheng)執(zhi)法(fa)(fa)機(ji)構,加(jia)強(qiang)(qiang)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)執(zhi)法(fa)(fa)隊伍(wu)建(jian)設,強(qiang)(qiang)化(hua)(hua)行政(zheng)(zheng)執(zhi)法(fa)(fa)職能(neng)。統籌(chou)加(jia)強(qiang)(qiang)安(an)(an)全(quan)(quan)監(jian)(jian)管(guan)力量,重點(dian)充實市(shi)、縣兩級安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)(jian)管(guan)執(zhi)法(fa)(fa)人員(yuan),強(qiang)(qiang)化(hua)(hua)鄉鎮(街道)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)(jian)管(guan)力量建(jian)設。完(wan)(wan)善各(ge)類開發區、工業園區、港區、風景區等功能(neng)區安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)(jian)管(guan)體制,明確負責(ze)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)(jian)督(du)(du)管(guan)理(li)的機(ji)構,以及(ji)港區安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)地方監(jian)(jian)管(guan)和部(bu)門監(jian)(jian)管(guan)責(ze)任。

(十二)健全應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)體制。按(an)照(zhao)政事分開原則,推進安(an)全生(sheng)(sheng)產應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)體制改革(ge),強化(hua)行政管理(li)職能(neng),提高組織協調(diao)能(neng)力和現場救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)時(shi)效。健全省、市、縣三級安(an)全生(sheng)(sheng)產應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)工(gong)作(zuo)機制,建(jian)設聯動互通(tong)的應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)指揮平臺。依托公安(an)消防、大型企業(ye)、工(gong)業(ye)園區(qu)等應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)力量(liang),加強礦山和危險化(hua)學品等應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)基地和隊伍建(jian)設,實行區(qu)域(yu)化(hua)應(ying)(ying)(ying)急(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)資源共享。

四、大(da)力推進依法治理

(十三)健全(quan)(quan)(quan)(quan)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)體系。建立(li)(li)健全(quan)(quan)(quan)(quan)安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)立(li)(li)改(gai)廢釋工作協調機制(zhi)(zhi)。加強涉及安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)相關法(fa)(fa)(fa)(fa)規(gui)(gui)一致性(xing)(xing)審(shen)查,增(zeng)強安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)(fa)(fa)制(zhi)(zhi)建設(she)的(de)(de)系統性(xing)(xing)、可(ke)操作性(xing)(xing)。制(zhi)(zhi)定安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)中長期(qi)立(li)(li)法(fa)(fa)(fa)(fa)規(gui)(gui)劃(hua),加快制(zhi)(zhi)定修訂安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)(fa)(fa)配套法(fa)(fa)(fa)(fa)規(gui)(gui)。加強安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)和(he)職業健康法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)銜接融合。研究修改(gai)刑法(fa)(fa)(fa)(fa)有關條款,將(jiang)生(sheng)產(chan)(chan)(chan)經營(ying)過程(cheng)中極易導致重大生(sheng)產(chan)(chan)(chan)安(an)(an)全(quan)(quan)(quan)(quan)事故(gu)的(de)(de)違法(fa)(fa)(fa)(fa)行為列入(ru)刑法(fa)(fa)(fa)(fa)調整范圍。制(zhi)(zhi)定完善高危行業領域安(an)(an)全(quan)(quan)(quan)(quan)規(gui)(gui)程(cheng)。設(she)區(qu)(qu)的(de)(de)市根據立(li)(li)法(fa)(fa)(fa)(fa)法(fa)(fa)(fa)(fa)的(de)(de)立(li)(li)法(fa)(fa)(fa)(fa)精神,加強安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)地方性(xing)(xing)法(fa)(fa)(fa)(fa)規(gui)(gui)建設(she),解(jie)決區(qu)(qu)域性(xing)(xing)安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)(chan)突出問題。

(十四)完善(shan)標(biao)(biao)(biao)準體系。加(jia)快安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)標(biao)(biao)(biao)準制(zhi)定修訂和(he)(he)整合,建立以強制(zhi)性國(guo)(guo)(guo)家標(biao)(biao)(biao)準為(wei)主(zhu)體的(de)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)標(biao)(biao)(biao)準體系。鼓(gu)勵依法成立的(de)社(she)會團體和(he)(he)企業制(zhi)定更加(jia)嚴格規范的(de)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)標(biao)(biao)(biao)準,結合國(guo)(guo)(guo)情積極借鑒實(shi)施(shi)國(guo)(guo)(guo)際先進標(biao)(biao)(biao)準。國(guo)(guo)(guo)務院安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)監(jian)督(du)管理部(bu)門負責(ze)生(sheng)(sheng)產(chan)(chan)經營(ying)單位(wei)職業危(wei)害預防治理國(guo)(guo)(guo)家標(biao)(biao)(biao)準制(zhi)定發布(bu)工(gong)作;統籌提出安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)強制(zhi)性國(guo)(guo)(guo)家標(biao)(biao)(biao)準立項(xiang)計劃,有關部(bu)門按(an)照職責(ze)分工(gong)組織起草、審查、實(shi)施(shi)和(he)(he)監(jian)督(du)執行(xing),國(guo)(guo)(guo)務院標(biao)(biao)(biao)準化行(xing)政主(zhu)管部(bu)門負責(ze)及時(shi)立項(xiang)、編號、對外通報(bao)、批(pi)準并發布(bu)。

(十五)嚴格安全(quan)(quan)準(zhun)入(ru)(ru)制度。嚴格高危行業領域安全(quan)(quan)準(zhun)入(ru)(ru)條件。按照強化監管與(yu)便(bian)民服(fu)務相結合原(yuan)則,科(ke)學設置安全(quan)(quan)生產(chan)行政許可(ke)事(shi)(shi)(shi)項(xiang)和(he)辦(ban)理(li)程序,優(you)化工作(zuo)流(liu)程,簡化辦(ban)事(shi)(shi)(shi)環節,實施(shi)網上公開辦(ban)理(li),接受(shou)社會監督(du)。對與(yu)人民群眾生命財產(chan)安全(quan)(quan)直(zhi)接相關(guan)的(de)(de)行政許可(ke)事(shi)(shi)(shi)項(xiang),依法嚴格管理(li)。對取消、下(xia)放(fang)、移交的(de)(de)行政許可(ke)事(shi)(shi)(shi)項(xiang),要加強事(shi)(shi)(shi)中事(shi)(shi)(shi)后(hou)安全(quan)(quan)監管。

(十六)規范(fan)監(jian)管執(zhi)(zhi)(zhi)法(fa)(fa)行(xing)(xing)(xing)為。完(wan)(wan)善(shan)(shan)(shan)安(an)(an)(an)全生(sheng)(sheng)產(chan)監(jian)管執(zhi)(zhi)(zhi)法(fa)(fa)制(zhi)度(du),明確每個生(sheng)(sheng)產(chan)經營單位安(an)(an)(an)全生(sheng)(sheng)產(chan)監(jian)督和管理主體,制(zhi)定(ding)實施(shi)執(zhi)(zhi)(zhi)法(fa)(fa)計劃,完(wan)(wan)善(shan)(shan)(shan)執(zhi)(zhi)(zhi)法(fa)(fa)程序規定(ding),依(yi)法(fa)(fa)嚴格(ge)查(cha)處各類違(wei)(wei)法(fa)(fa)違(wei)(wei)規行(xing)(xing)(xing)為。建(jian)立行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)和刑事司法(fa)(fa)銜接制(zhi)度(du),負有安(an)(an)(an)全生(sheng)(sheng)產(chan)監(jian)督管理職(zhi)責的(de)(de)部門(men)要加強與公安(an)(an)(an)、檢(jian)察院(yuan)、法(fa)(fa)院(yuan)等協(xie)調配合,完(wan)(wan)善(shan)(shan)(shan)安(an)(an)(an)全生(sheng)(sheng)產(chan)違(wei)(wei)法(fa)(fa)線索(suo)通報(bao)、案件移送與協(xie)查(cha)機制(zhi)。對違(wei)(wei)法(fa)(fa)行(xing)(xing)(xing)為當(dang)事人拒不執(zhi)(zhi)(zhi)行(xing)(xing)(xing)安(an)(an)(an)全生(sheng)(sheng)產(chan)行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)決定(ding)的(de)(de),負有安(an)(an)(an)全生(sheng)(sheng)產(chan)監(jian)督管理職(zhi)責的(de)(de)部門(men)應依(yi)法(fa)(fa)申(shen)請司法(fa)(fa)機關(guan)強制(zhi)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)。完(wan)(wan)善(shan)(shan)(shan)司法(fa)(fa)機關(guan)參與事故調查(cha)機制(zhi),嚴肅查(cha)處違(wei)(wei)法(fa)(fa)犯罪行(xing)(xing)(xing)為。研究建(jian)立安(an)(an)(an)全生(sheng)(sheng)產(chan)民事和行(xing)(xing)(xing)政(zheng)公益訴訟制(zhi)度(du)。

(十七)完善執(zhi)法監(jian)督(du)機(ji)制(zhi)(zhi)。各級人(ren)大(da)常委會(hui)要定(ding)期(qi)檢查(cha)安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)法律法規實施(shi)情況,開(kai)展(zhan)專題詢問。各級政協(xie)要圍繞安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)突出問題開(kai)展(zhan)民主監(jian)督(du)和(he)協(xie)商調研。建立執(zhi)法行(xing)為審議制(zhi)(zhi)度(du)和(he)重大(da)行(xing)政執(zhi)法決策機(ji)制(zhi)(zhi),評(ping)估執(zhi)法效果,防止濫(lan)用職(zhi)權。健全(quan)(quan)領(ling)導干部非(fei)法干預安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)監(jian)管執(zhi)法的記(ji)錄、通報和(he)責(ze)任追究制(zhi)(zhi)度(du)。完善安(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)執(zhi)法糾錯和(he)執(zhi)法信息公開(kai)制(zhi)(zhi)度(du),加強(qiang)社會(hui)監(jian)督(du)和(he)輿論監(jian)督(du),保證(zheng)執(zhi)法嚴明、有錯必糾。

(十八)健全(quan)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)保障體系。制(zhi)定(ding)安全(quan)生(sheng)(sheng)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)監(jian)(jian)(jian)察(cha)能(neng)力建(jian)(jian)設(she)規(gui)劃,明確監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)裝備(bei)及現場執(zhi)(zhi)法(fa)(fa)和(he)應急救援(yuan)用車配備(bei)標準,加強(qiang)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)技術(shu)支撐(cheng)體系建(jian)(jian)設(she),保障監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)需要。建(jian)(jian)立完(wan)善負(fu)有安全(quan)生(sheng)(sheng)產(chan)(chan)監(jian)(jian)(jian)督管(guan)(guan)(guan)理職責(ze)的部門監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)經費保障機(ji)制(zhi),將監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)經費納入同級財政全(quan)額(e)保障范圍。加強(qiang)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)制(zhi)度化、標準化、信(xin)息化建(jian)(jian)設(she),確保規(gui)范高效監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)。建(jian)(jian)立安全(quan)生(sheng)(sheng)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)依法(fa)(fa)履(lv)行法(fa)(fa)定(ding)職責(ze)制(zhi)度,激勵保證監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)忠于職守、履(lv)職盡責(ze)。嚴格(ge)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)資(zi)格(ge)管(guan)(guan)(guan)理,制(zhi)定(ding)安全(quan)生(sheng)(sheng)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)錄用標準,提(ti)高專業監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)比例。建(jian)(jian)立健全(quan)安全(quan)生(sheng)(sheng)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)凡進必考(kao)、入職培訓(xun)、持證上崗和(he)定(ding)期輪訓(xun)制(zhi)度。統一安全(quan)生(sheng)(sheng)產(chan)(chan)執(zhi)(zhi)法(fa)(fa)標志標識(shi)和(he)制(zhi)式服裝。

(十九(jiu))完(wan)善(shan)事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)處理機制。堅(jian)持問責與整(zheng)改(gai)(gai)并(bing)重,充分發揮事(shi)(shi)(shi)故(gu)(gu)查(cha)(cha)(cha)(cha)處對加(jia)強和(he)改(gai)(gai)進(jin)安全(quan)(quan)生產工(gong)作的(de)促進(jin)作用。完(wan)善(shan)生產安全(quan)(quan)事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)組組長(chang)負責制。健全(quan)(quan)典型(xing)事(shi)(shi)(shi)故(gu)(gu)提級(ji)調查(cha)(cha)(cha)(cha)、跨(kua)地(di)區協同調查(cha)(cha)(cha)(cha)和(he)工(gong)作督導機制。建(jian)立(li)事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)分析(xi)技(ji)術支撐體(ti)系,所有(you)事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)報(bao)告要設(she)立(li)技(ji)術和(he)管理問題專篇(pian),詳(xiang)細分析(xi)原因并(bing)全(quan)(quan)文發布,做好解讀,回應公(gong)眾關切。對事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)發現有(you)漏洞、缺陷的(de)有(you)關法(fa)律法(fa)規和(he)標準制度(du)(du),及(ji)時啟動制定修訂工(gong)作。建(jian)立(li)事(shi)(shi)(shi)故(gu)(gu)暴露(lu)問題整(zheng)改(gai)(gai)督辦制度(du)(du),事(shi)(shi)(shi)故(gu)(gu)結案后一年內,負責事(shi)(shi)(shi)故(gu)(gu)調查(cha)(cha)(cha)(cha)的(de)地(di)方(fang)政(zheng)府和(he)國務院有(you)關部(bu)門要組織(zhi)開展評(ping)估,及(ji)時向社會公(gong)開,對履職不(bu)力、整(zheng)改(gai)(gai)措施不(bu)落實的(de),依(yi)法(fa)依(yi)規嚴肅追究有(you)關單位和(he)人員責任。

五、建立安全預防控制體系

(二十)加強安(an)全風(feng)險(xian)管(guan)(guan)控。地方各級(ji)政府要建(jian)立(li)完(wan)善(shan)安(an)全風(feng)險(xian)評估(gu)(gu)與論(lun)證機(ji)(ji)制(zhi),科學(xue)合理確定(ding)企業(ye)(ye)選(xuan)址和(he)基(ji)礎設(she)施建(jian)設(she)、居(ju)民生活區空(kong)間布局(ju)。高危項(xiang)目審批(pi)必須(xu)(xu)把安(an)全生產(chan)作(zuo)為(wei)前置條件,城(cheng)鄉規劃(hua)布局(ju)、設(she)計、建(jian)設(she)、管(guan)(guan)理等各項(xiang)工作(zuo)必須(xu)(xu)以(yi)安(an)全為(wei)前提,實(shi)行(xing)(xing)重(zhong)大(da)(da)安(an)全風(feng)險(xian)“一票否決”。加強新(xin)材(cai)料(liao)、新(xin)工藝、新(xin)業(ye)(ye)態安(an)全風(feng)險(xian)評估(gu)(gu)和(he)管(guan)(guan)控。緊密結合供給側結構性改(gai)革,推動高危產(chan)業(ye)(ye)轉型(xing)升級(ji)。位置相(xiang)鄰、行(xing)(xing)業(ye)(ye)相(xiang)近、業(ye)(ye)態相(xiang)似的地區和(he)行(xing)(xing)業(ye)(ye)要建(jian)立(li)完(wan)善(shan)重(zhong)大(da)(da)安(an)全風(feng)險(xian)聯(lian)(lian)防聯(lian)(lian)控機(ji)(ji)制(zhi)。構建(jian)國家、省、市、縣四(si)級(ji)重(zhong)大(da)(da)危險(xian)源信(xin)息管(guan)(guan)理體系,對重(zhong)點行(xing)(xing)業(ye)(ye)、重(zhong)點區域、重(zhong)點企業(ye)(ye)實(shi)行(xing)(xing)風(feng)險(xian)預警(jing)控制(zhi),有效(xiao)防范重(zhong)特大(da)(da)生產(chan)安(an)全事故(gu)。

(二(er)十一)強化企(qi)業(ye)預防措施。企(qi)業(ye)要(yao)定期(qi)開(kai)展風險評(ping)估和(he)危害辨識。針對高危工(gong)藝、設(she)備(bei)、物品、場所和(he)崗位(wei),建(jian)立(li)(li)分級管控制(zhi)度(du),制(zhi)定落實(shi)(shi)安(an)全(quan)操(cao)作規程。樹立(li)(li)隱患就是事(shi)故(gu)的(de)(de)觀念,建(jian)立(li)(li)健全(quan)隱患排查(cha)治理(li)制(zhi)度(du)、重(zhong)大(da)隱患治理(li)情況向(xiang)負有安(an)全(quan)生產監督(du)管理(li)職責的(de)(de)部(bu)門和(he)企(qi)業(ye)職代會“雙報(bao)告”制(zhi)度(du),實(shi)(shi)行(xing)(xing)自查(cha)自改自報(bao)閉環(huan)管理(li)。嚴格(ge)執行(xing)(xing)安(an)全(quan)生產和(he)職業(ye)健康“三(san)同(tong)時”制(zhi)度(du)。大(da)力(li)推進(jin)企(qi)業(ye)安(an)全(quan)生產標(biao)準化建(jian)設(she),實(shi)(shi)現安(an)全(quan)管理(li)、操(cao)作行(xing)(xing)為、設(she)備(bei)設(she)施和(he)作業(ye)環(huan)境的(de)(de)標(biao)準化。開(kai)展經常(chang)性的(de)(de)應急演(yan)練(lian)和(he)人員(yuan)避險自救培(pei)訓,著(zhu)力(li)提升現場應急處置(zhi)能(neng)力(li)。

(二十二)建立(li)隱(yin)(yin)患治理監督(du)機制(zhi)。制(zhi)定(ding)生產安(an)全事故隱(yin)(yin)患分級和(he)(he)排(pai)(pai)查(cha)(cha)治理標準。負有(you)安(an)全生產監督(du)管理職責(ze)的(de)部門(men)要(yao)建立(li)與企(qi)(qi)業(ye)隱(yin)(yin)患排(pai)(pai)查(cha)(cha)治理系統聯網的(de)信息平臺,完善線上(shang)線下配(pei)套監管制(zhi)度。強化隱(yin)(yin)患排(pai)(pai)查(cha)(cha)治理監督(du)執法(fa),對(dui)重(zhong)大隱(yin)(yin)患整(zheng)改(gai)不(bu)到位的(de)企(qi)(qi)業(ye)依(yi)法(fa)采取停產停業(ye)、停止(zhi)施工、停止(zhi)供電(dian)和(he)(he)查(cha)(cha)封扣押(ya)等強制(zhi)措施,按規(gui)定(ding)給予上(shang)限經濟處罰(fa),對(dui)構成犯罪的(de)要(yao)移交司(si)法(fa)機關依(yi)法(fa)追究(jiu)刑事責(ze)任(ren)。嚴格重(zhong)大隱(yin)(yin)患掛牌督(du)辦(ban)制(zhi)度,對(dui)整(zheng)改(gai)和(he)(he)督(du)辦(ban)不(bu)力的(de)納入政(zheng)府核查(cha)(cha)問責(ze)范(fan)圍,實行(xing)約談告誡、公(gong)開(kai)曝光,情節(jie)嚴重(zhong)的(de)依(yi)法(fa)依(yi)規(gui)追究(jiu)相關人員(yuan)責(ze)任(ren)。

(二十三)強(qiang)化城市(shi)運行(xing)安(an)全保障。定(ding)期排查區域內安(an)全風險點(dian)、危(wei)險源,落實管(guan)控措施,構建系統性、現代(dai)化的城市(shi)安(an)全保障體系,推(tui)進安(an)全發展示范城市(shi)建設。提(ti)高基礎(chu)設施安(an)全配(pei)置標準,重點(dian)加(jia)強(qiang)對城市(shi)高層建筑、大型(xing)綜合體、隧道(dao)橋梁、管(guan)線管(guan)廊、軌(gui)道(dao)交(jiao)通、燃氣、電(dian)力設施及(ji)電(dian)梯、游樂設施等(deng)的檢測維護(hu)。完善(shan)大型(xing)群(qun)眾性活動安(an)全管(guan)理制度,加(jia)強(qiang)人員密集場所安(an)全監管(guan)。加(jia)強(qiang)公(gong)安(an)、民政、國土資源、住房城鄉建設、交(jiao)通運輸、水利、農(nong)業、安(an)全監管(guan)、氣象、地震(zhen)等(deng)相(xiang)關部門的協(xie)調(diao)聯動,嚴防自然災(zai)害引(yin)發事(shi)故。

(二十四)加(jia)(jia)(jia)強(qiang)重點領(ling)域工(gong)(gong)程(cheng)治(zhi)理(li)。深入推進對煤礦瓦斯、水害等重大災害以及礦山采空(kong)區(qu)、尾礦庫(ku)的工(gong)(gong)程(cheng)治(zhi)理(li)。加(jia)(jia)(jia)快實施人口密集區(qu)域的危險化(hua)學品和化(hua)工(gong)(gong)企業生產、倉儲場所安(an)(an)全搬遷(qian)工(gong)(gong)程(cheng)。深化(hua)油(you)氣開(kai)采、輸送、煉化(hua)、碼(ma)頭接卸等領(ling)域安(an)(an)全整治(zhi)。實施高(gao)速公(gong)路(lu)(lu)(lu)、鄉(xiang)村公(gong)路(lu)(lu)(lu)和急彎陡(dou)坡、臨水臨崖危險路(lu)(lu)(lu)段(duan)公(gong)路(lu)(lu)(lu)安(an)(an)全生命防(fang)護工(gong)(gong)程(cheng)建(jian)設。加(jia)(jia)(jia)強(qiang)高(gao)速鐵路(lu)(lu)(lu)、跨海大橋、海底隧道、鐵路(lu)(lu)(lu)浮橋、航(hang)運(yun)樞紐、港口等防(fang)災監(jian)測(ce)、安(an)(an)全檢測(ce)及防(fang)護系統(tong)建(jian)設。完善(shan)長途客(ke)運(yun)車(che)輛、旅游客(ke)車(che)、危險物品運(yun)輸車(che)輛和船舶生產制(zhi)造標準,提高(gao)安(an)(an)全性(xing)能,強(qiang)制(zhi)安(an)(an)裝(zhuang)(zhuang)智能視頻監(jian)控報警、防(fang)碰撞和整車(che)整船安(an)(an)全運(yun)行監(jian)管技術(shu)裝(zhuang)(zhuang)備(bei),對已(yi)運(yun)行的要(yao)加(jia)(jia)(jia)快安(an)(an)全技術(shu)裝(zhuang)(zhuang)備(bei)改造升級(ji)。

(二十五)建立(li)完(wan)(wan)善職(zhi)(zhi)(zhi)業(ye)(ye)病防(fang)治體(ti)系。將職(zhi)(zhi)(zhi)業(ye)(ye)病防(fang)治納入各(ge)級政府民(min)生工程及安全生產(chan)工作考核(he)體(ti)系,制定(ding)(ding)職(zhi)(zhi)(zhi)業(ye)(ye)病防(fang)治中長期規劃,實施職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)促進計(ji)劃。加快職(zhi)(zhi)(zhi)業(ye)(ye)病危害(hai)(hai)嚴重企(qi)業(ye)(ye)技術(shu)改造、轉型(xing)升級和淘汰退出,加強高危粉塵、高毒(du)物品等(deng)職(zhi)(zhi)(zhi)業(ye)(ye)病危害(hai)(hai)源(yuan)頭(tou)治理。健(jian)(jian)(jian)全職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)監(jian)管(guan)支撐(cheng)保(bao)(bao)障體(ti)系,加強職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)技術(shu)服務機(ji)構(gou)(gou)、職(zhi)(zhi)(zhi)業(ye)(ye)病診(zhen)(zhen)斷(duan)鑒(jian)定(ding)(ding)機(ji)構(gou)(gou)和職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)體(ti)檢(jian)(jian)機(ji)構(gou)(gou)建設,強化職(zhi)(zhi)(zhi)業(ye)(ye)病危害(hai)(hai)基礎研究、預防(fang)控制、診(zhen)(zhen)斷(duan)鑒(jian)定(ding)(ding)、綜合治療能力。完(wan)(wan)善相關規定(ding)(ding),擴(kuo)大職(zhi)(zhi)(zhi)業(ye)(ye)病患者救治范圍,將職(zhi)(zhi)(zhi)業(ye)(ye)病失能人員納入社會保(bao)(bao)障范圍,對(dui)符合條(tiao)件的職(zhi)(zhi)(zhi)業(ye)(ye)病患者落實醫療與生活救助措施。加強企(qi)業(ye)(ye)職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)監(jian)管(guan)執法(fa),督(du)促落實職(zhi)(zhi)(zhi)業(ye)(ye)病危害(hai)(hai)告知、日常監(jian)測、定(ding)(ding)期報告、防(fang)護保(bao)(bao)障和職(zhi)(zhi)(zhi)業(ye)(ye)健(jian)(jian)(jian)康(kang)(kang)體(ti)檢(jian)(jian)等(deng)制度措施,落實職(zhi)(zhi)(zhi)業(ye)(ye)病防(fang)治主體(ti)責任。

六、加強安全基礎(chu)保障能力建設(she)

(二十六(liu))完(wan)善安(an)(an)(an)全投(tou)入(ru)長效機制。加(jia)(jia)強(qiang)中央和地方財政(zheng)安(an)(an)(an)全生產(chan)(chan)預防(fang)(fang)及(ji)應急(ji)相(xiang)關(guan)資金使用(yong)(yong)管(guan)理,加(jia)(jia)大安(an)(an)(an)全生產(chan)(chan)與(yu)職業(ye)健康投(tou)入(ru),強(qiang)化(hua)審(shen)計監督。加(jia)(jia)強(qiang)安(an)(an)(an)全生產(chan)(chan)經(jing)濟政(zheng)策研究,完(wan)善安(an)(an)(an)全生產(chan)(chan)專(zhuan)用(yong)(yong)設備(bei)企(qi)業(ye)所得稅優惠(hui)目(mu)錄。落實企(qi)業(ye)安(an)(an)(an)全生產(chan)(chan)費用(yong)(yong)提(ti)取管(guan)理使用(yong)(yong)制度(du),建立企(qi)業(ye)增加(jia)(jia)安(an)(an)(an)全投(tou)入(ru)的激勵約束機制。健全投(tou)融資服務(wu)(wu)體系,引導企(qi)業(ye)集聚(ju)發展災害防(fang)(fang)治、預測預警、檢測監控、個體防(fang)(fang)護、應急(ji)處置、安(an)(an)(an)全文(wen)化(hua)等技術、裝備(bei)和服務(wu)(wu)產(chan)(chan)業(ye)。

(二(er)十七)建立安(an)(an)(an)全(quan)(quan)科技(ji)支(zhi)撐體系。優化(hua)(hua)整合國(guo)家科技(ji)計劃,統籌支(zhi)持安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)和(he)(he)職業(ye)健(jian)康領域科研(yan)項目,加(jia)強研(yan)發基地和(he)(he)博士(shi)后(hou)科研(yan)工(gong)作(zuo)站建設(she)。開展事(shi)故預(yu)防理論研(yan)究(jiu)和(he)(he)關(guan)(guan)鍵技(ji)術(shu)裝備研(yan)發,加(jia)快(kuai)成(cheng)果(guo)轉化(hua)(hua)和(he)(he)推(tui)(tui)廣應(ying)用。推(tui)(tui)動工(gong)業(ye)機器(qi)人(ren)、智能裝備在危險工(gong)序(xu)和(he)(he)環節廣泛應(ying)用。提升(sheng)現代(dai)信息技(ji)術(shu)與安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)融合度,統一標準(zhun)規范(fan),加(jia)快(kuai)安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)信息化(hua)(hua)建設(she),構建安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)與職業(ye)健(jian)康信息化(hua)(hua)全(quan)(quan)國(guo)“一張(zhang)網”。加(jia)強安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)理論和(he)(he)政策(ce)研(yan)究(jiu),運用大數據技(ji)術(shu)開展安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)規律性、關(guan)(guan)聯性特征(zheng)分析,提高安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)(chan)決策(ce)科學化(hua)(hua)水平。

(二十八(ba))健(jian)全社會化(hua)(hua)(hua)服(fu)(fu)務(wu)體(ti)系(xi)。將安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)專業(ye)技(ji)術(shu)服(fu)(fu)務(wu)納入現代服(fu)(fu)務(wu)業(ye)發(fa)展規(gui)(gui)劃,培育(yu)多元化(hua)(hua)(hua)服(fu)(fu)務(wu)主體(ti)。建(jian)立政府購買安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)服(fu)(fu)務(wu)制(zhi)度(du)。支持(chi)發(fa)展安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)專業(ye)化(hua)(hua)(hua)行業(ye)組織,強化(hua)(hua)(hua)自治自律。完(wan)善(shan)注冊安(an)(an)全工程(cheng)師制(zhi)度(du)。改革完(wan)善(shan)安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)和職業(ye)健(jian)康技(ji)術(shu)服(fu)(fu)務(wu)機構資(zi)質(zhi)管理(li)辦(ban)法。支持(chi)相關(guan)機構開展安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)和職業(ye)健(jian)康一體(ti)化(hua)(hua)(hua)評(ping)(ping)價(jia)等(deng)技(ji)術(shu)服(fu)(fu)務(wu),嚴格實(shi)施評(ping)(ping)價(jia)公(gong)開制(zhi)度(du),進一步激活和規(gui)(gui)范專業(ye)技(ji)術(shu)服(fu)(fu)務(wu)市場。鼓(gu)勵中小微企業(ye)訂單(dan)式、協作式購買運用(yong)安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)管理(li)和技(ji)術(shu)服(fu)(fu)務(wu)。建(jian)立安(an)(an)全生(sheng)(sheng)(sheng)產(chan)(chan)和職業(ye)健(jian)康技(ji)術(shu)服(fu)(fu)務(wu)機構公(gong)示制(zhi)度(du)和由第三方實(shi)施的信用(yong)評(ping)(ping)定制(zhi)度(du),嚴肅(su)查(cha)處租借(jie)資(zi)質(zhi)、違法掛靠、弄虛作假、壟斷收費等(deng)各類違法違規(gui)(gui)行為(wei)。

(二十九)發揮市場(chang)機制(zhi)(zhi)(zhi)推(tui)動作用(yong)。取消安(an)全(quan)生(sheng)(sheng)產(chan)風險抵押金制(zhi)(zhi)(zhi)度(du)(du),建(jian)(jian)立健全(quan)安(an)全(quan)生(sheng)(sheng)產(chan)責任保(bao)險制(zhi)(zhi)(zhi)度(du)(du),在礦(kuang)山(shan)、危險化學品、煙花爆竹、交通運輸、建(jian)(jian)筑施工、民用(yong)爆炸物品、金屬冶(ye)煉、漁業(ye)生(sheng)(sheng)產(chan)等高危行(xing)業(ye)領域強制(zhi)(zhi)(zhi)實施,切實發揮保(bao)險機構參與風險評估管(guan)控和事故預防功能(neng)。完善工傷(shang)保(bao)險制(zhi)(zhi)(zhi)度(du)(du),加快制(zhi)(zhi)(zhi)定工傷(shang)預防費用(yong)的提取比例、使用(yong)和管(guan)理具體(ti)辦法。積極推(tui)進安(an)全(quan)生(sheng)(sheng)產(chan)誠信體(ti)系(xi)建(jian)(jian)設,完善企業(ye)安(an)全(quan)生(sheng)(sheng)產(chan)不良記錄“黑名單”制(zhi)(zhi)(zhi)度(du)(du),建(jian)(jian)立失(shi)信懲戒和守信激(ji)勵機制(zhi)(zhi)(zhi)。

(三十)健全(quan)(quan)(quan)(quan)安全(quan)(quan)(quan)(quan)宣(xuan)傳教育體(ti)系(xi)。將安全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)監督管理納入(ru)各(ge)級黨政領導干部培訓內容(rong)。把安全(quan)(quan)(quan)(quan)知識(shi)普及納入(ru)國民教育,建立(li)完(wan)善中小學安全(quan)(quan)(quan)(quan)教育和(he)(he)高危(wei)行業(ye)(ye)(ye)職業(ye)(ye)(ye)安全(quan)(quan)(quan)(quan)教育體(ti)系(xi)。把安全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)納入(ru)農民工(gong)技(ji)能培訓內容(rong)。嚴(yan)格落實(shi)企業(ye)(ye)(ye)安全(quan)(quan)(quan)(quan)教育培訓制度(du),切實(shi)做到先培訓、后上崗。推進安全(quan)(quan)(quan)(quan)文化(hua)建設,加強(qiang)警示教育,強(qiang)化(hua)全(quan)(quan)(quan)(quan)民安全(quan)(quan)(quan)(quan)意(yi)識(shi)和(he)(he)法治意(yi)識(shi)。發揮工(gong)會、共青(qing)團(tuan)、婦聯等群團(tuan)組(zu)織(zhi)作(zuo)用,依(yi)法維(wei)護職工(gong)群眾的(de)知情權、參與權與監督權。加強(qiang)安全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)公(gong)益(yi)宣(xuan)傳和(he)(he)輿論監督。建立(li)安全(quan)(quan)(quan)(quan)生(sheng)產(chan)(chan)“12350”專線與社會公共管理平(ping)臺統一(yi)接報(bao)、分類(lei)處置的舉(ju)報(bao)投訴(su)機制。鼓勵開展安(an)(an)全(quan)生產(chan)志愿(yuan)服務和慈善事業。加(jia)強安(an)(an)全(quan)生產(chan)國(guo)(guo)際交流(liu)合作,學習借鑒國(guo)(guo)外安(an)(an)全(quan)生產(chan)與職(zhi)業健康(kang)先進經驗。

各地區各部門要加強組織領導,嚴格實行領導干部安(an)全生(sheng)產工(gong)作責任制,根據本意見提出的任務(wu)和(he)要求(qiu),結合實際(ji)認真(zhen)研(yan)究制定實施辦法,抓緊出臺推(tui)進安(an)全生(sheng)產領域改革(ge)發展的具體(ti)政策措施,明確責任分(fen)工(gong)和(he)時間進度要求(qiu),確保各項(xiang)改革(ge)舉措和(he)工(gong)作要求(qiu)落實到(dao)位。貫徹落實情況要及時向黨中(zhong)央、國務(wu)院報告,同(tong)時抄(chao)送國務(wu)院安(an)全生(sheng)產委(wei)員會辦公室(shi)。中(zhong)央全面深(shen)化改革(ge)領導小組辦公室(shi)將適時牽頭組織開展專項(xiang)監督(du)檢(jian)查。
